Picky Pear — Terms of Service

1. Eligibility

You must be at least 13 years old to use the Service (or older if the laws of your country require a higher minimum age — for example, 16 in some European Union countries — for using online services without parental consent). By using the Service you represent that you meet this requirement. We do not knowingly allow children under 13 to create accounts.

2. Your account

You are responsible for the accuracy of your account information and for keeping your credentials secure. You may sign in with an email address and password or through a third-party identity provider (Google, Apple). You can delete your account at any time from Profile → Settings → Account → Delete account, or as described on the account deletion page.

3. User content and code of conduct

Picky Pear lets you create polls, upload images and videos, vote, and comment ("User Content"). You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, translate, and distribute your User Content solely to operate and improve the Service.

We have zero tolerance for objectionable content and abusive behavior. You agree not to post content that:

• is unlawful, defamatory, threatening, harassing, or bullying;
• contains hate speech or discriminates against any group;
• is pornographic, sexually explicit, or sexualizes minors in any way;
• depicts graphic violence or promotes self-harm;
• is spam, deceptive, or infringes intellectual-property or privacy rights of others;
• impersonates any person or entity.

Content is published when you post it. We use automated safety checks on published text and uploaded media, user reports, blocking tools, and human review of reported or flagged content. Automated checks can make mistakes; contact us if you believe your content was hidden incorrectly. We may remove or hide any content and suspend or terminate any account that violates these Terms, without prior notice. The app provides tools to report objectionable polls and comments and to block abusive users; we review reports and act on them promptly, normally within 24 hours.

4. Free service

Picky Pear is free to use. All features, including anonymous polls, seeing who voted, and AI-generated Pearsona cards (see our Privacy Policy for how that data is processed), are available to registered users at no charge. The Service offers no in-app purchases or subscriptions and never asks for payment details.

5. Intellectual property

The Service, including its design, logos, and software, is owned by us or our licensors and is protected by law. These Terms do not grant you any rights to our trademarks or branding.

6. Disclaimer and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. Poll results, Pearsona cards, and other content are provided by users or generated from user activity and are not verified by us. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data or profits, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law, and nothing affects statutory rights you have as a consumer.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or where required by law. Sections that by their nature should survive termination (content license for already-distributed content, disclaimers, limitations of liability) survive.

8. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page; for material changes we will provide notice in the app. Continued use of the Service after the changes take effect constitutes acceptance.
